THEFT OF SERVICE

A person commits the offense of theft of service when he or she, with the intent to avoid payment for a service that is provided only for compensation: (1) intentionally or knowingly secures the performance of the service by deception, threat, or false token; (2) intentionally or knowingly diverts the service to his or her own use; (3) holds personal property beyond the expiration of a rental period; or (4) intentionally or knowingly obtains the performance of the service by agreeing to provide compensation and fails to make payment after receiving notice of a demand for payment.

SCHOOL SEARCHES

The basic requirement for a search of a student is the reasonableness of the search. If the school officials have a reasonable belief that the search will produce evidence that the student has violated any rules of the school, the officials may search the student.

Statements of Juveniles

After a juvenile has been arrested, they have the right to receive Miranda rights and the right to be represented by counsel. The juvenile also has the right to be free from self-incrimination as provided under the Fifth Amendment to the United States Constitution.

Appellate Review of Comments During Closing Arguments and Standards of Review

When a defendant appeals his conviction on the basis that the trial court erred in overruling his objection to the prosecutor's improper comments made during closing arguments, the appellate court will analyze the entire closing argument. The trial court is given wide discretion with respect to closing arguments.

MANUFACTURING CONTROLLED SUBSTANCES

A person commits a criminal offense if he or she manufactures a controlled substance without authorization, if he or she manufactures a counterfeit or a simulated substance with the intent to deliver a controlled substance, or if he or she manufactures drug paraphernalia with the intent to deliver the drug paraphernalia to a person who intends to violate the drug laws.
